This limited warranty is effective from the stated date of purchase for a period of ONE (1) YEAR from the date of retail purchase by the original end user.
IMPORTANT: BY USING YOUR PRODUCT YOU AGREE TO BE SUBJECT TO THE TERMS OF THE LIMITED ONE (1) YEAR WARRANTY FROM PHOENIX – 10545996 CANADA INC. (THE “WARRANTY”) DEFINED BELOW.
Cases of limitation, exclusion, and invalidity of the warranty
This warranty binds PHOENIX – 10545996 CANADA INC. with the original end user of the products only.
The responsibility of PHOENIX – 10545996 CANADA INC. is limited to the original value of the product recognized as defective by PHOENIX – 10545996 CANADA INC.
Under no circumstances PHOENIX – 10545996 CANADA INC. will not be held responsible or liable for any other direct or indirect damage, including, but not exhaustively: loss of profits or income resulting from or relating to any defect in the products covered by this warranty or any use of such products by the owner or any other person, or for any delay in honouring this warranty due to circumstances beyond the control of PHOENIX – 10545996 CANADA INC.
This warranty covers manufacturing defects in materials only and does not include defects and damage attributable to or being caused by or resulting from improper installation.
PHOENIX – 10545996 CANADA INC. can in no way be held responsible for non-compliance with the building code(s) or regulations in force.
Product adjustments or replacement of normal wear parts, such as the soap dispenser and paper dispenser are not covered by the warranty.
Any replacement of parts will not have the effect of extending the duration of the warranty or modifying it. The original warranty will continue according to the terms, conditions, and the remaining period if applicable.
PHOENIX – 10545996 CANADA INC. reserves the right to cease manufacturing a product or component at any time. In such a case, the company may, at its discretion, either replace the defective product with a substitute or similar product, or grant the customer a credit equivalent to the price paid by the latter for the component.
None of our employees or agents has the authority to make any representation or warranty which exceeds the warranties set forth above.
